The Maine attorney general says a police officer and a game warden were justified in using deadly force in a shooting that killed a former Marine outside the Department of Veterans Affairs hospital in Augusta.

A report issued Tuesday found that 37-year-old James Popkowski of Medway was shot on July 8 after he refused orders to drop a handgun he had pointed at Game Warden Sgt. Ronald Dunham and VA police Officer Thomas Park.

Dunham and Park both fired at the same time, killing Popkowski.

Last week, the VA released a report that said Popkowski's case highlighted the need for corrective actions by the Maine VA hospital.

The state report says Popkowski first drew the attention of law enforcement in December 2009 because of his threats against the VA.
