Irish nanny charged in Mass. baby's death seeks release on bail while awaiting trial

WOBURN, Mass. – An Irish nanny accused of killing a baby in her care in Massachusetts has asked a judge to grant bail so she can be released from jail while awaiting trial.

Lawyers for Aisling (ASH'-ling) Brady McCarthy argued Tuesday prosecutors have failed to turn over critical evidence they need to defend her against murder charges in the death of Rehma Sabir (REM'-uh suh-BEHR'), of Cambridge.

They also say the case against McCarthy is weaker than prosecutors claimed after she was arrested. They cite notes of police interviews in which they say the baby's mother appears to have said "no issues with nanny" when questioned the night the baby was hospitalized with severe head injuries on her first birthday in January. The baby died two days later.

Prosecutors say McCarthy "violently" injured the baby.

The judge hasn't ruled.
