A 6-year-old central Florida boy has died five years after he nearly drowned in a backyard pool.

Joey Cosmillo's family told the Orlando Sentinel (http://bit.ly/JGyVfy) the child died Sunday night at his home.

Grandmother Maggie Cosmillo called the boy a "warrior" who loved Elmo.

The newspaper reported the boy received 24-hour nursing care at home until state cutbacks took most of that away. She said the last year had taken a toll on the child's heath.

The near-drowning gained attention after a Casselberry, Fla., police officer sued the family because she slipped on the floor while paramedics were tending to the boy after he was pulled from the pool. Sgt. Andrea Eichorn dropped the lawsuit. She was fired from the police department and lost her state law enforcement credentials.
