The Tucson Unified School District is at risk of losing state funding over its alleged failure to comply with a state ban on ethnic studies.

Arizona public schools chief John Huppenthal said Friday that the school district is not in compliance with the ban that was enacted in 2010 and adopted by TUSD in 2012.

Students and teachers have sued Arizona, claiming the ban is overly broad and violates free speech rights. Oral arguments are scheduled for Jan. 12 in that case in the 9th U.S. Circuit Court of Appeals.

Huppenthal says some TUSD schools are still teaching ethnic solidarity. He cited an introduction to hip-hop from an African-American perspective class as a violation.

TUSD has until March 4 to comply or lose 10 percent of state funding.
