The civil trial between former pro wrestler Terry ‘Hulk Hogan’ Bollea and the website Gawker set for July 6 has been postponed.
On Thursday, the 2nd District Court of Appeals filed a proceeding regarding trial rules, stating that some of the defense motions were filed too close to the scheduled start date for trial.
An attorney for Bollea, David Houston, released a statement saying: “We are very disappointed we do not get to begin presenting Mr. Bollea’s case on Monday. We will reset the case for trial against Gawker and proceed we hope in the near future.”
“One way or another Mr. Bollea will receive justice,” Houston added.
Bollea is suing Gawker for $100 million after a 2006 video of him having sex with Heather Clem, then-wife of radio host and his friend “Bubba the Love Sponge” Clem, was posted on Gawker.com. Gawker’s founder Nick Denton claimed the tape, which garnered over 2.5 million views, was newsworthy.
President and General Counsel for Gawker Heather Dietrick sees this trial delay as an important ruling for Gawker.
“The delay of the trial provides us the important opportunity to find out more about the three Hulk Hogan video recordings obtained by the FBI that appear highly relevant to the facts of the case,” Dietrick said in a statement. “We have the right to know the full story and are concerned because one of the tapes produced by the FBI today is incomplete while there is a serious irregularity in another tape."
No new date has yet been set for the trial.
