A man summoned as a potential juror in the Colorado theater shooting case told a judge that his son was in the multiplex on the night of the attack.

It was not immediately clear Thursday if the son was in the theater where the gunman opened fire.

The judge did not immediately decide whether to dismiss the father.

Jury selection began Jan. 20 with prospective panelists filling out questionnaires. Lawyers are expected to begin oral questioning of candidates next week.

Defendant James Holmes sat quietly during the Thursday proceedings. He is accused of killing 12 people and injuring 70 others in the 2012 attack in the Denver area.

He has pleaded not guilty by reason of insanity. Prosecutors are seeking the death penalty.
