SANFORD, Fla. – The attorney for the man charged in the fatal shooting of Florida teenager Trayvon Martin is fighting a prosecution request for his client's medical records.
Mark O'Mara will ask the judge in the case to throw the state's subpoena in a hearing Friday. George Zimmerman, who is charged with second-degree murder in the February shooting, is not expected to be in attendance.
In a notice objecting to the subpoena for Zimmerman's records, O'Mara argues that the requested records are privileged. He also calls the prosecution's request "overbroad" and says that it would include information that is irrelevant to the case and is not admissible.
O'Mara recently appealed Judge Kenneth Lester's decision not to recuse himself from the case, as the defense had requested.
