Dallas police say they are seeking a grand jury indictment against an officer who shot a mentally ill man in a disputed incident caught on tape.

A police statement Thursday said Officer Cardan Spencer was fired over the Oct. 14 shooting and his case would be forwarded to a grand jury.

Police Chief David Brown initially said that Spencer was charged with aggravated assault. In a statement issued later Thursday, police said a judge who was presented with the arrest warrant directed police to take the case to a grand jury.

Spencer wrote in a police report that he shot Bobby Gerald Bennett after the man lunged at him with a knife. But video shows Bennett didn't appear to move toward the officers.
