A U.S. Border Patrol agent has been charged with assaulting two people who stopped to help his wife after she was fatally struck by a vehicle while lying in a northern New York road.

Meanwhile, state police are investigating the wife's death.

State police say 34-year-old Bryan McDonald, of Lyon Mountain, was charged Monday with assault for hitting a 66-year-old man and a 65-year-old woman in the face late on the night of Dec. 4. Troopers say the two had stopped to offer assistance after 33-year-old Ashley McDonald was hit by a vehicle in Massena.

Capt. Robert LaFountain told the Press-Republican of Plattsburgh (http://goo.gl/TdSWhS ) that Ashley McDonald was riding with her husband before she was struck, but he didn't provide other details.

Information on McDonald's lawyer wasn't available from prosecutors.
