A suspect is in custody in a shooting near New York City's Penn Station that killed one man and wounded two others.

Police say the gunman was taken into custody early Thursday. Charges against him are pending.

Police said earlier that the three victims were at a McDonald's in midtown Manhattan on Monday when the gunman engaged them in a brief conversation, left the restaurant and then waited for them to exit.

Police say the gunman fired four shots at the men near the entrance to a subway station.

A 43-year-old man shot in the neck was pronounced dead at the scene. The two other victims were hospitalized.

The McDonald's where the men were approached has become a gathering place for addicts who attend nearby substance abuse programs.
