A man serving time in a Pennsylvania prison has been charged in the 2003 killing of an ax murderer's 3-year-old son.

David Charles Cummings was charged Thursday with murder, aggravated assault, rape and other offenses in the death of his stepson William Spayd.

William's biological father, Chester Spayd, killed his own mother's former boyfriend with an ax in 2000 and is serving 30 to 60 years in prison.

The Berks County district attorney's office says Cummings confessed during a July police interview that he killed William.

Online court records don't list a lawyer to comment on the charges.

The 50-year-old Cummings has been incarcerated since being convicted of burglary and arson in 2004.

Police say Cummings told a 911 dispatcher William was not breathing. The boy's siblings weren't injured.
