An Irish ex-nanny is being deported after Massachusetts prosecutors dropped a murder charge against her in the death of a 1-year-old girl.

U.S. Immigration and Customs Enforcement says 37-year-old Aisling Brady McCarthy surrendered Tuesday at its office in the Boston suburb of Burlington.

The agency says she's been arrested, pending deportation to Ireland, which is being expedited at her request.

McCarthy entered the country 13 years ago under a visa waiver program that allowed her to stay 90 days.

In 2013, she was charged in the death of Rehma Sabir, of Cambridge.

On Monday, prosecutors dropped the charge after the medical examiner's office revised its original homicide ruling. The office determined a possibly undiagnosed condition could have led to the baby's death.

McCarthy's lawyers didn't immediately comment on the deportation.
