GADSDEN, Ala. – A judge is ordering prosecutors to turn over evidence about the death of a 9-year-old girl who police say was run to death by her grandmother.
Lawyers for the woman, Joyce Garrard, complained during a hearing Friday that they still don't have police statements provided by eight witnesses.
Prosecutors denied withholding any evidence. But Etowah County Circuit Judge Billy Ogletree ordered them to provide defense attorneys with the material by Monday afternoon.
The 48-year-old Garrard is set for trial in June on a capital murder charge in the 2012 death of granddaughter Savannah Hardin.
Prosecutors say Garrard ran the girl to death as punishment for a lie. Garrard says she is innocent.
The defense is seeking information about Alabama's lethal injection procedures, but the judge didn't rule on the request.
