Prosecutors have dropped a robbery charge against a college student who dressed as Spider-Man after a convenience store owner testified he believes the incident was just a "silly mistake."

The Pittsburgh Tribune-Review reports 21-year-old Jonathan Hewson was being released from jail in Pittsburgh on Tuesday.

The University of Pittsburgh student  was arrested shortly after police say he walked into the store about 1:10 a.m. Sept. 20 -- dressed in the superhero costume -- and asked "How much money you got?"

Hewson's friends say he's simply a Spider-Man enthusiast who meant no harm. At a preliminary hearing Tuesday, clerk Bob Patel told a judge he didn't want to ruin Hewson's career saying, "He just made a silly mistake."

Hewson's attorney hopes to get his record expunged and Hewson readmitted to school.
