Investigators say a former Colorado police officer shot and killed a man in the back after stopping him on the street and following him to his home.

James Ashby has been charged with second-degree murder in the October shooting death of 27-year-old Jack Jacquez in the rural community of Rocky Ford.

In court documents released Thursday, investigators allege Ashby aggressively pursued Jacquez after stopping him as he skateboarded along a street at night. They say Ashby fatally shot him even as Jacquez was moving away and wasn't a threat.

Ashby suspected that Jacquez might be trying to burglarize the home and getting ready to strike him with a bat, but the officer's account was contradicted by the evidence and a man who was doing a ride-along with Ashby that night.
