A lawyer for the family of a college student killed by New York police says the shooting was "intentional murder."

Attorney Michael Sussman made the charge as he renewed his demand for an independent prosecutor in the Oct. 17 killing of Pace University football player Danroy Henry. The 20-year-old student from Easton, Mass., was shot dead in his car.

Witness accounts of the shooting have differed sharply. A grand jury is investigating.

Sussman says the fatal bullets were fired by Pleasantville Officer Aaron Hess.

A lawyer for Hess hasn't returned phone and e-mail messages seeking comment. He said earlier this month Henry's car hit Hess and threw him onto the hood, then kept accelerating. He said Hess had no alternative but to fire at the driver.
