The family of a bodega worker shot and killed by police as he fled an armed robbery has filed a $25 million lawsuit against the New York Police Department.

Twenty-year-old Reynaldo Cuevas was running away from the ambush in September when he slammed into Officer Ramysh Bangali. The officer was responding to the robbery call. Investigators say the impact caused the officer's gun to discharge and a stray bullet hit Cuevas, killing the young father.

Cuevas' mother has filed a wrongful death lawsuit against the city, NYPD and Bangali. The suit says Cuevas was shot "without reason or provocation."

An investigation by the Bronx district attorney's office cleared Bengali of committing any crime.

The three alleged robbers are charged with felony murder in Cuevas' death.
