An ex-basketball coach for three Tennessee high school students who were convicted of assaulting their teammate has asked a judge to dismiss charges against him.

Media outlets report Andre Montgomery asked Wednesday that his four charges of failure to report child abuse be dismissed.

Gatlinburg police say that on Dec. 22, the three players assaulted a freshman with a pool cue. On Tuesday in juvenile court, one player was found guilty of aggravated rape and two others were found guilty of aggravated assault.

Montgomery's attorney, Curtis Bowe, said his client had no obligation to report the abuse, saying the law is unclear on what to do when a child abuses another child.

Judge Don Poole postponed his ruling until the state Attorney General can weigh in on the law.
