A Houston man accused of fatally shooting a sheriff's deputy at a gas station last year is set to return to court following the completion of a competency evaluation after his stay at a state mental hospital.

Court records show that a sealed competency evaluation of Shannon Miles was filed Wednesday.

Miles has spent the last several months at the North Texas State Hospital after he was ruled incompetent to stand trial for the August 2015 killing of Deputy Darren Goforth, who was shot 15 times while refueling his patrol car.

A bench warrant filed Tuesday ordered Miles' return to Houston for a Sept. 20 hearing.

Miles' attorney, Anthony Osso, didn't immediately return a phone call Wednesday.

Records show Miles has previously been committed to mental health facilities.
