A defense attorney says his client fatally shot himself in the head while on a lunch break during his aggravated assault trial.

Fifty-seven-year-old Wylie Chambers was found next to his car on the second floor of the parking garage on Wednesday.

Attorney Charles Holloman told the Ocala Star-Banner (http://bit.ly/1JRkxQq ) Chambers was "unusually upset" about the possibility of going to prison. He also said Chambers was concerned about his dog, which was undergoing cancer surgery Wednesday.

Circuit Judge Hale Stancil said Chambers faced up to 40 years. He'd turned down a plea deal for a three-year sentence.

He was accused of pointing a gun at two relatives and then shooting into the ground.

Chambers had hoped for probation, but would have had to serve prison time if convicted.
