BOSTON – A federal appeals court has agreed to hold a hearing on a request from lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev (joh-HAHR' tsahr-NEYE'-ehv) to move his trial outside Massachusetts.
The 1st U.S. Circuit Court of Appeals scheduled the hearing for Feb. 19.
Tsarnaev's lawyers have repeatedly argued that he cannot get a fair trial in Massachusetts because of the emotional impact the deadly 2013 attack had here. Three people were killed and more than 260 were injured.
The appeals court rejected the defense request to suspend jury selection immediately but agreed Thursday to hold a hearing.
Judge George O'Toole Jr. has rejected three change-of-venue motions. Last week, the judge said the jury selection process has identified people who have shown they can be fair and impartial.
