ROSEVILLE, Mich. -- Authorities were continuing to investigate Tuesday the drive-by shooting of a 10-month-old Michigan boy after questioning and releasing their prime suspect.
Kevin Lee Smith, the ex-boyfriend of the baby's mother, voluntarily went to a police station Monday to protest his innocence, the Detroit Free Press reported.
Authorities said they did not have enough evidence to hold or charge Smith, 27, but Deputy Chief James Berlin told The Free Press that he remained "the focus of our investigation."
Smith is not the injured boy's father, but he is involved in a bitter custody dispute with the mother over another child.
The shooting occurred around 11:00pm local time Saturday in Roseville, Mich., about 19 miles northeast of Detroit. Police said the boy was sleeping on a couch in the home with his mother when someone fired several shots from a high-caliber handgun into the home.
The baby boy was struck in the head. He was taken to the hospital, where he remained in critical condition Tuesday. He is expected to survive.
