PHILADELPHIA – A judge who lodged a nearly $1 million fine against a Philadelphia-area lawyer believes the attorney intentionally elicited banned testimony that caused a mistrial — and then lied about it.
The judge says Berwyn lawyer Nancy Raynor failed to instruct the witness that he could not say the patient in a medical malpractice case had smoked.
Raynor insists the expert blurted out the smoking reference despite her warnings.
But Philadelphia Common Pleas Judge Paul Panepinto says in an opinion Wednesday that Raynor has changed her story several times since the 2012 trial. He finds her in contempt and awards the opposing side about $950,000 in expenses from the retrial.
Raynor vows to fight the sanctions at a Feb. 19 hearing.
She says the fine jeopardizes her family and law practice.
