A court has ruled that prosecutors can use a blood sample as evidence to prove an Indianapolis police officer was driving drunk when he caused a fatal crash.
The Indiana Court of Appeals on Wednesday reversed a county judge's decision that the blood is inadmissible as evidence that David Bisard was driving drunk because it wasn't drawn according to procedures outlined in state law.
The appeals court says the drawing of blood met state requirements and that legislators wouldn't have intended such samples to be suppressed.
The sample showed Bisard had a blood-alcohol content of more than twice the legal limit when his cruiser crashed into two motorcycles stopped at a traffic light, killing one person and injuring two others.
Bisard's attorney and prosecutors had no immediate comment.
