GREENVILLE, Ala. – A former Alabama state trooper charged with rape is fighting a request to submit a saliva sample to authorities, who say in court documents he told a woman he'd throw her in jail if she didn't have sex with him.
Prosecutors say they need the saliva sample to ensure a complete investigation in the case of Samuel McHenry, who was arrested and charged with rape and sodomy after the alleged assault Dec. 6.
McHenry's attorneys have asked for an oral argument on the request and say they'd like to have an expert present if any samples are taken to ensure they're taken properly.
A judge on Wednesday postponed a preliminary hearing until March 3.
McHenry is free on bond. Phone calls and emails to McHenry's attorney haven't been returned.
