A Pennsylvania prosecutor has dropped all charges against a man who served 34 years in prison for the shooting death of a 15-year-old before new DNA evidence was discovered.

A judge issued the order freeing 63-year-old Lewis Fogle in Indiana County last month. But Fogle was merely released on bond until Indiana County District Attorney Patrick Dougherty (DOH'-her-tee) agreed Monday to dismiss charges against him in the rape and murder of Deann Katherine Long in 1976.

The judge's decision stemmed from a joint motion by the Innocence Project and Dougherty (DOH'-her-tee).

But Dougherty wanted to review other evidence before deciding whether to retry Fogle.

Fogle was arrested in 1981. He says he hopes anyone who was involved will be brought to justice.
