A California mother is filing an emergency appeal to keep her toddler on life support after a lower court's order runs out on Friday.

Attorneys for Jonee Fonseca filed their appeal Tuesday with the 9th U.S. Circuit Court of Appeals.

U.S. District Court Judge Kimberly Mueller in Sacramento last week rejected ordering Kaiser Permanente Medical Center in Roseville to keep 2-year-old Israel Stinson on life support.

Two hospitals have determined he is brain dead, but Fonseca wants time to find another facility for him.

Fonseca says Israel moved in response to touch even after he was declared dead.

Fonseca's appeal urges the appeals court to keep him on life support because the alternative is irreversible once Mueller's one-week stay expires on Friday.

A Kaiser spokesman did not immediately comment.
