A California judge has refused to revoke the release of a serial rapist amid fears by neighbors that he would rape again.

The Los Angeles County district attorney's office says that a Santa Clara County judge on Monday denied its request to revoke Christopher Hubbart's conditional release.

Prosecutors say Hubbard had violated the terms of his release. They asked the judge to return him to a mental hospital less than a year after his release to a neighborhood in the Antelope Valley outside Los Angeles.

Hubbart's neighbors say they fear Hubbart would rape again.

The 64-year-old Hubbart is required to wear a monitoring device around his ankle, attend therapy, undergo polygraph exams and submit to random searches of his house. He also lives with an around-the-clock security guard.
