Lawsuit claiming Britney Spears' slept with Kevin Federline's brother a hoax?

Court documents claiming Kevin Federline's brother, Chris, is the father of Britney Spears' oldest son, Sean, are a hoax, says Federline's aunt, Diane Story.

“We pity the hoaxter for believing they could get by such a crazy story and for also believing they could damage the reputation of America’s pop princess," Story told the entertainment website Celebuzz.

FOX411 reached out to both Federline and Spears on Thursday after reports of the lawsuit surfaced earlier this week, but received no reply from either.

In the papers, reported first by RadarOnline and posted on US Weekly’s website, an individual claming to be Christopher Federline said he was the “true father” of her son Sean Preston, 7. He’s also alleed that the “X Factor” judge stole his credit card and used his money to buy thousands of dollars worth of comics for her kids.

“I do confess I slept with Britney, and I am the true father, but the public does not need to know," the documents stated.

But Celebuzz reports a Tampa, Florida judge has thrown out the suit because it believes it is the work of serial hoaxter and convicted felon Jonathan Lee Riches.

Riches was arrested last week on a federal probation violation charge when he traveled to Newtown, Conn. and claimed he was the uncle of Sandy Hook Elementary school suspect Adam Lanza, according to The Smoking Gun. Riches was even photographed and interviewed at the memorial outside the Sandy Hook Elementary School.

Riches had been convicted on wire fraud charges, and while in prison, filed hundreds of fake lawsuits naming famous athletes, politicians, and celebrities like the Kardashian family as defendants, The Smoking Gun reports.

Story said the fake filing was hurtful to her family, and that Kevin Federline's brother never would have slept with his then-wife Spears.

“Kevin and Chris are close and will always be," she said.

Spears was married to Kevin Federline from 2004-2006. She gave birth to Sean Preston in Sept. 2005 and had her second son with Federline, Jayden James, shortly before she filed for divorce in 2006. Kevin was granted sole physical and legal custody of the children in 2008.

Spears is currently engaged to her former agent Jason Trawick.
