DAYTON, Ohio – A woman who said her Ohio doctor kissed her during an exam has been awarded $30,000 in a ruling that referred to the movie "Casablanca."
In his decision issued Wednesday in Dayton, Montgomery County Common Pleas Magistrate David Fuchsman quoted lyrics from the film's signature song, "As Time Goes By." He asked, "When is a kiss not just a kiss?" Fuchsman said the answer is: "When the kiss is planted on an unsuspecting patient, by her family physician."
The magistrate awarded civil damages and attorney fees to the woman, who had accused her family physician of making sexual advances during the office visit.
Forty-seven-year-old Dr. Shafik Ahmad denied the allegation at a hearing last week.
