A mistrial was declared for two Los Angeles men accused of spraying bullets into a crowd in a 2006 gang attack that killed a 10-year-old boy and two other people.

A judge declared the mistrial Wednesday for Ryan Moore and Charles Smith after jurors deadlocked.

Prosecutors must decide whether to retry the men for murder and attempted murder. Another hearing is set for next month.

Authorities claimed Moore and Smith fired more than 30 rounds from AK-47 rifles into a group outside a South Los Angeles home.

The attack killed 10-year-old David Marcial, his uncle and a 17-year-old neighbor. Marcial's 12-year-old brother survived.

Authorities say the attack was aimed at gang rivals but none of the victims were gang associates.
