Charges against a married Indian couple accused of obscenity for allegedly kissing in public have been thrown out by a high court judge, the BBC reported Wednesday.
"It is inconceivable how... an expression of love by a young married couple would attract an offence of obscenity and trigger the coercive process of law," said Judge S. Muralidhar.
Delhi police arrested the 28-year-old man and 23-year-old woman in September for, "sitting in an objectionable position near a metro pillar and kissing due to which passersby were feeling bad," according to the BBC.
In court documents, the couple deny they were kissing and claim they were instead taking self portraits on their cell phones.
If found guilty, the couple would've faces three months in prison.
