A court in Australia has said that two men who were born females can legally be considered male without undergoing a sex change surgery, the Australian Associated Press reported.

The transsexuals, whose names are being withheld for privacy, won the appeal after the West Australia Gender Reassignment Board refused to issue them certificates that recognized them as females.

The board said since they had female reproductive systems, they were “inconsistent with being male,” according to the news report.

However, the State Administrative Tribunal ruled that although the men did not have sex change surgeries, they were infertile, and “presented as, and appeared to be, males.”

“Both applicants had undergone bilateral mastectomies and testosterone treatment as a result of which each had undergone extensive physical changes consistent with being male,” the tribunal ruled.
