A Cincinnati lawyer wants to call former Defense Secretary Donald Rumsfeld as a material witness in the upcoming trial of some anti-war demonstrators.

Attorney Bill Gallagher plans to file a motion today seeking to subpoena Rumsfeld. Gallagher says it's no publicity stunt and that he wants the former Pentagon boss to be questioned about the death toll and cost of the Iraq war.

In late September, five adults and two juveniles were arrested and charged with trespassing after a sit-in at Rep. Steve Chabot's downtown Cincinnati office. The trial of the adult protestors is scheduled to begin January 22.
