The attorney for a Cleveland man accused of taking his 5-year-old son from the Alabama home of the boy's mother in 2002 and creating new identities says he will plead not guilty next week.

Bobby Hernandez is due to be arraigned Tuesday on charges that include kidnapping, forgery and tampering with records.

Authorities say Hernandez moved to Cleveland and built a new life for himself and his son.

The ruse fell apart this fall when discrepancies with his 18-year-old son's Social Security number were discovered as he began the college application process.

Defense attorney Ralph DeFranco says the 53-year-old Hernandez and his son have talked on the phone since his arrest in early November. But the two have not seen each other since Hernandez has been in jail.
