SEATTLE – Washington's former state auditor will be in a courtroom once again as prosecutors try him a second time on allegations that he stole from clients while running a real-estate services business during the height of last decade's housing boom.
Jury selection is due to begin Monday.
Troy Kelley's federal fraud trial last year ended with an acquittal on one count and a deadlocked jury on more than a dozen others.
Newly recovered emails could shed light on whether Kelley was entitled to pocket roughly $3 million the government says he stole while running Post Closing Department, which tracked escrow paperwork for title companies.
The emails were pulled off archival magnetic tapes maintained by Fidelity, a title company Kelley worked with. Prosecutors say they prove Kelley wasn't supposed to keep the money.
Kelley maintains that other documents show he was entitled to the money.
