NEW ORLEANS – The last of the "Angola Three" inmates, Albert Woodfox is now expected to stay behind bars until at least the end of the summer.
An appeals panel Friday ruled that Woodfox must stay in jail until it hears arguments in late August on Louisiana's push to retry him in the death of Louisiana State Penitentiary prison guard Brent Miller.
The court also said the state had made a strong showing that it might succeed with its appeal to retry Woodfox.
If it does, it would mean a third trial for Woodfox in the 1972 slaying of Miller.
It was a blow for Woodfox.
A lower court judge Monday had ordered his "immediate" release, and barred a retrial, saying there was no way the state could give him a fair trial.
