Tatum O'Neal was out and about in New York on Monday night, drinking out of what resembled a wine glass.
But her rep told FOXNews.com that O'Neal was drinking ginger ale in the photograph taken at the New York City Ballet's 24th annual Dance with the Dancers gala.
"This is certainly different from 'Dancing with the Stars,'" O'Neal told Fashion Week Daily's Jim Shi. "But if you're going to walk on thin ice, you might as well dance!"
Monday's party was the first public appearance for the "Rescue Me" star since her June 1 arrest for allegedly buying cocaine in Manhattan.
"I'm still sober!" the Oscar-winning actress, who has publicly battled drug addiction, told the New York Post two hours after being sprung from a night in jail. "Just when I was about to change that and wreck my life, the cops came and saved me!" she said.
O'Neal, 44, was released without bail after her cocaine-possession arrest. She was arraigned in Manhattan Criminal Court on a misdemeanor charge of possession of a controlled substance and entered no plea.
The actress reportedly enrolled in a local AA program after she was released from jail. "I'm doing very well. I'm going to an AA meeting," she said on June 3.
Prosecutors are recommending drug treatment for O'Neal, who detailed her dependency on heroin and cocaine in her 2004 memoir, "A Paper Life."
She is due in court later this month.
O'Neal, daughter of Ryan O'Neal, was 10 when she won an Academy Award for best supporting actress for 1973's "Paper Moon." She is the youngest person ever to win an Oscar.
