Court Documents: Bobby Cutts Jr. Killed Jessie Davis at Home

CANTON, Ohio – Court documents in the murder of a 9-months-pregnant Ohio mom indicate that her boyfriend killed her inside her home and his accomplice gave false statements to investigators, FOX News has learned.

The documents, obtained by FOX News, show that 30-year-old Bobby Cutts Jr., who is in police custody and awaiting arraignment Monday, killed Jessie Davis, 26, at her home in North Canton.

His high school friend, Myisha Ferrell — who has also been arrested and charged with obstruction of justice — "communicated false information to investigators," according to the court papers.

Cutts' arraignment is scheduled for 3 p.m. EDT Monday. He is the father of Davis' 2-year-old son Blake, who may have witnessed his mother's killing, and also probably of her unborn daughter, who was due July 3.

Ferrell will also be arraigned Monday at 3 p.m.

On Sunday, the medical examiner confirmed that the body found at the end of a days-long search was Davis. The search ended Saturday when police announced the discovery and said they believed it was Davis. Cutts was arrested Saturday on two counts of murder — one for Davis, the other for the baby — and Ferrell was arrested Sunday.

Agents and Stark County sheriff's deputies arrested Ferrell, described as a former classmate of the man being held for arraignment on murder charges, after breaking down the door of her apartment Saturday night, FBI agent Scott Wilson said.

Davis was reported missing after her mother found Davis' 2-year-old son home alone, bedroom furniture toppled and bleach spilled on the floor.

The boy gave investigators their first clues. "Mommy was crying. Mommy broke the table. Mommy's in rug," the boy said.

The Canton Repository reported that sheriff's deputies searched Ferrell's Canton apartment to look for DNA trace evidence, including blood, hair and fibers “which may be used as evidence of the crime of obstructing justice,” according to the search warrant signed by Stark County Common Pleas Judge John Haas. Ferrell and Cutts went to high school together.

Officers removed about eight brown paper evidence bags and several smaller envelope-sized bags from the apartment, the paper reported.

When asked by FOX News if Ferrell was being investigated as a potential accomplice, FBI agent Scott Wilson replied,"We will continue to look at anybody who might pop up in this investigation that was close to [Cutts] and certainly anyone who had involvement in Jessie’s disappearance."

A church service to show support for Cutts that was scheduled before the body was found was closed to the media. Cutts' pastor, the Rev. C.A. Richmond, declined to comment on his way into the service.

Thousands of volunteers had searched for Davis over several days, while investigators continued to question Cutts, 30, who is the father of Davis' son but is married to another woman.

Investigators were mum on many details of their work until they announced Cutts was taken into custody Saturday and was to be arraigned on charges of murder in the deaths of Davis and her unborn child.

The Stark County Sheriff's Department said a woman's body was recovered in Summit County at 3:30 p.m.

Television news footage taken from helicopters above Cuyahoga Valley National Park showed investigators riding off-road vehicles to reach an area that is heavily covered with trees and brush. It also show authorities carrying a body bag on a stretcher and loading it into a white van.

Roger Riggins, an investigator with the Summit County medical examiner's office, confirmed the body was found at the southeast edge of the park, about 25 miles from Davis' home in Lake Township.

The medical examiner's office performed an autopsy Sunday using dental records to identify the body. Earlier, officials said it might be difficult to determine the cause of death because of the advanced state of decomposition.

Tim Miller, director of Texas EquuSearch, an internationally active search group that organized the volunteer effort, said Davis' mother, Patricia Porter, and other members of her family were called together and told about the body in late afternoon.

An attorney for Davis' mother said the family had a roller coaster ride of emotions and had no comment.

Cutts, a Canton police officer since 2000, has said he and his wife are separated and that she knew about the affair with Davis.

Chief Deputy Rick Perez said the case was still being investigated. He would not comment on whether there were any other suspects.
