Hi, I'm Bill O'Reilly. Thank you for watching us tonight.

Deception in the Toogood case.  That's the subject of this evening's Talking Points Memo.

I hope you saw last night's interview with Steven Rosen, Madelyne Toogood's attorney.  We challenged Mr. Rosen's assertion that John and Madelyne Toogood are good parents and produced evidence they are not, they are criminals, with assets far beyond their means.

And now we have more information for you.  The Factor producer Dan Cohen has uncovered records that John Lark, a.k.a. Johnny Toogood, has an extensive criminal record.  He has been arrested in Chicago, Philadelphia, Akron, Ohio, and Montana.  He's been convicted of at least two felonies and has another pending in Whitefish, Montana.

His wife, Madelyne, has a criminal record and at least three expensive automobiles registered to her in different states.  But if you aren't watching us, you'd never know that.

Rosen and Miss Toogood appeared on Good Morning America, the CBS morning news [The Early Show on CBS] CNN with Paula Zahn, Larry King, and her lawyer with Connie Chung.  Most of those interviews allowed Miss Toogood to portray herself as a loving parent who just made a mistake.

Nowhere was a pattern of criminal behavior illuminated.  And remember, these people have three children they're hauling around the country and exposing to criminal behavior.  And perhaps the worst example of this whitewash, Paula Zahn asked Madelyne Toogood, quote, "What is it you're trying to teach Americans about what went wrong that day?"

With all due respect to Miss Zahn, a former colleague, come on!  It is simply irresponsible to allow that woman to teach America anything on national television.  She is a disgrace.  And some of the media gave her a phony platform that is also disgraceful.

The no spin truth in this is this, these Toogood parents are grifters.  The father steals from 80-year-old women.  When caught, he told the Philly police, quote, "I'm down on my luck and I just needed money for my family.  It's not right that a lot of other people make a lot more money.  All the men in my family do this.  This isn't a violent crime."

This guy's down on his luck?  So how did his wife manage to obtain a Mercedes, Cadillac, and $40,000 SUV?

The question now becomes, what about the kids?  We know about 4-year-old Martha.  But how about the two boys, ages 5 and 6?  Should society remove these kids from this criminal enterprise?  Because that's what it is.

Talking Points realizes this is a very difficult question.  Foster care is no easy road.  But these parents are grossly irresponsible, despite what you've seen and heard on other television outlets.

We'll continue to watch this case very closely for the sake of those children.

And that's The Memo.

The Most Ridiculous Item of the Day

Time now for "The Most Ridiculous Item of the Day."

Earlier in the broadcast, you heard Bob Fertik, the founder of democrats.com, say that a new CBS poll opposed military action in Iraq.  I told Mr. Fertik that was not true, and it's not.  Here are the poll numbers.

When asked by CBS, "Do you approve or disapprove of the United States taking military action against Iraq to try to remove Saddam Hussein from power?" 68 percent of Americans approved, 26 percent disapproved.

Once again, this is a No Spin Zone.  We are not going to tolerate deception by anyone because it is ridiculous, all right?
