A Florida Uber driver and retired NYPD cop fired his registered gun at a passenger who had turned violent Sunday night, according to reports.

Steven Rayow, 74, was not charged after the incident, in which he shot his alleged assailant in the foot, but police are still investigating. However, he was suspended by Uber, which prohibits drivers from carrying weapons. Rayow told police he picked up Marc Gregory Mermel, 60, in Clearwater Beach at around 10 p.m. on Sunday night, and the two began arguing, according to The Washington Times.

Rayow claimed he was being choked and losing consciousness when he pulled out his gun and fired.
