Total Recall? Russell Pearce Case to be Considered by Arizona Supreme Court

Will a drive to recall Russell Pearce go on as planned, or will it be dashed by a court decision?

That is the question that will be answered after the Arizona Supreme Court on Tuesday scheduled to consider whether to allow a Nov. 8 recall election to be held for state Senate President, a Republican known nationally for championing legislation against illegal immigration.

A Pearce supporter appealed a trial judge's Aug. 12 ruling that denied the supporter's request to call off the election in Pearce's legislative district in Mesa, a Phoenix suburb.

The challenge alleged flaws in the recall drive's paperwork meant that recall supporters hadn't submitted enough valid voter signatures to force the recall.

Issues in the case included whether petition circulators determined that voters' signatures were "genuine" and whether voters residing in the district could sign the petition though their voter registrations still had previous addresses outside the district.
