A senior administration official deeply involved in White House deliberations about the future location and judicial venue of Khalid Sheik Mohammed and four other alleged 9/11 conspirators told Fox a decision on the case is "weeks away" and will not be made or announced before President Obama leaves for Guam, Indonesia and Australia on March 18.
The official said the decision about the trial's location and whether it will occur in a military commission is linked to a "basket of other issues" including obtaining congressional funding for the Thomson Maximum Security prison in Illinois- the designated successor to Guantanamo Bay as a detainee holding facility - as well as congressional funding for other terror trials in federal civilian courts. Another issue tied up with the 9/11 co-conspirator case is producing a law on the permanent detention of terrorist suspects who are too dangerous to be released but unable to be tried in civilian or military courts because evidence collected was tainted by harsh interrogation tactics or for other reasons.
"That decision (on the KSM trial) is part of a basket of issues that is bigger than one case or one decision about one case," the senior official said.
