Defense attorneys in the Colorado movie theater shooting case say the Arapahoe (uh-RAP'-uh-hoh) County district attorney made inappropriate comments about the upcoming trial that are further evidence the trial should be moved.

The defense says District Attorney George Brauchler told a reporter he wants the case tried in Arapahoe County and talked about his fairness and sense of justice.

According to the Denver Post (http://tinyurl.com/qjdg4yj), the defense said in a filing made public Tuesday that those comments could bias jurors against defendant James Holmes. Twelve people were killed and 70 injured in the 2012 attack.

A spokeswoman for the district attorney on Tuesday declined comment.

Holmes has pleaded not guilty by reason of insanity. Prosecutors are seeking the death penalty.
