Lawyers for Colorado theater shooting suspect James Holmes are objecting to a Fox News reporter's request to delay her court appearance to testify about her confidential sources.

In a motion made public Tuesday, Holmes' lawyers say a New York judge rejected Jana Winter's request for an immediate stay.

Winter lives there and is scheduled to appear Monday in Colorado.

The Colorado judge hearing Holmes' case hasn't said when he would rule on the requested delay.

Winter reported that Holmes sent a psychiatrist drawings that foreshadowed the July 20 attack, which killed 12 and injured 70. She quoted unnamed law-enforcement officials.

Holmes' lawyers say that violated a gag order. They want to know who was responsible.

Winter's lawyer argues that New York's "shield law" allows her to keep her sources confidential.
