Prep school graduate gets a chance to be released from jail

A New Hampshire prep school graduate convicted of sexually assaulting a 15-year-old freshman as part of a game of sexual conquest is getting another chance to be released from jail while he appeals.

A judge revoked Owen Labrie's bail in March after he admitted violating his curfew. He appealed that decision to the state Supreme Court, which on Thursday sent the matter back to the trial court.

Justices note that Labrie could end up serving his entire one-year sentence before his direct appeal is decided. They say the lower court should consider whether Labrie has been jailed long enough to understand the importance of complying with his bail conditions. Labrie's attorney says the ruling encourages her.

Labrie was arrested in 2014 days after graduating from St. Paul's School in Concord.
