No charges against officers in fatal NC shooting

Published November 17, 2014

Prosecutors say they won't file charges against the five law enforcement officers who fired at a 19-year-old who was killed during a hostage standoff at a bank in North Carolina.

Wake County District Attorney Colon Willoughby Jr. said Friday that no charges will be filed against four Cary police officers and a Wake County sheriff's deputy who shot at Devon Mitchell outside a Wachovia bank in February. Willoughby reviewed a State Bureau of Investigation report before making his decision.

Officers fired at least 12 times at Mitchell, who was later determined to be unarmed. Willoughby wrote that the SBI report shows that Mitchell pressed his hand, concealed by a knit cap, against a teller's head. The report says Mitchell said he was holding a semi-automatic pistol under the cap.
