Murder conviction overturned in 2015 Erie party slaying

An appeals court has overturned a murder conviction in a slaying at an outdoor party following an all-star high school football game in Pennsylvania almost three years ago.

Darion Eady was convicted of murder in the death of 16-year-old Elijah Jackson at the Erie party in July 2015. The 23-year-old Eady has been serving a 23- to 47-year sentence.

But a three-judge Superior Court panel ruled unanimously Wednesday there wasn't enough evidence to sustain murder, reckless-endangerment and weapons possession convictions. A conviction on a firearms violation was upheld.

Defense attorney Emily Merski says Eady cannot be retried for the homicide. Prosecutors are unavailable for comment.

Three people were charged in the death of another youth killed by gunfire from an SUV at the party.
