Lawyers say uncertainty over cause of cloudy execution drug in Georgia requires review

Attorneys for a Georgia woman on death row say apparent uncertainty about what caused cloudiness in a lethal injection drug strengthens their argument that her execution be stayed until a judge determines her rights won't be violated.

State officials on March 2 called off the execution of Kelly Renee Gissendaner, saying the drug appeared "cloudy."

The Georgia Department of Corrections said in an April 16 news release that an expert found the problem likely was caused by shipping and storing the drug at a temperature that was too low.

A court filing last week showed the department had done its own test ending April 3 showing cold temperature had no effect on another stored sample.

Gissendaner's attorneys argued late Thursday that the state's motion to dismiss her civil rights complaint should be denied.
