DA says he won't prosecute upstate NY man who put 4 boys in closet after vandalism spree

A district attorney says he won't prosecute a New York man who corralled four boys in a closet when he found them vandalizing a relative's home.

Wayne County District Attorney Richard Healy tells The Associated Press on Thursday that he reviewed Jesse Daniels' case and is recommending that a town justice dismiss the four counts of endangering the welfare of a child.

Police charged the 53-year-old man this month after the parents of the boys, ages 8 and 10, complained that he handled them roughly after finding them damaging his father-in-law's home in Clyde.

Daniels says he took hammers away from the boys and put the four children in a closet until police arrived. He says the damage topped $40,000.

Healy says he expects the justice to dismiss the charges Wednesday.
